Board Decision No. 2016-002
Pertaining To
Stallworth Pipestem Basketball Hoop Nuisance
Background
A homeowner living on the Stallworth Court pipestem complained to the president about a basketball hoop situated near the apron of the Stallworth Court pipestem driveway. The matter was referred to the Architectural Control Committee who determined that the basketball hoop is a nuisance as defined under our covenants and restrictions. The owner of the basketball hoop claims a portion of the pipestem driveway is actually on their property and the Association has permitted basketball hoops without exception everywhere else in our subdivision including two others on the pipestem.
Resolution
The Board of Directors agree not to pursue covenants and restrictions enforcement to direct removal of basketball hoop near the apron of the Stallworth Court pipestem rather preferring that the neighbors involved with this issue speak directly with each other to resolve this complaint.
