Collection Policy

Members of the West Park Community Association (WPCA) are required to pay annual maintenance assessments in accordance with Article IV, Covenant For Maintenance Assessments, of the WPCA Declaration of Covenants, Conditions and Restrictions. The annual assessments are billed during the month of January each year.

This policy addresses the actions the Association shall take in the event that annual assessments are not paid on time, meaning by not more than 30 days from the date of the billing invoice. This policy implements the provisions of Section 8, Effect of Nonpayment of Assessments: Remedies of the Association, of Article IV, Covenant For Maintenance Assessments, of the WPCA Declaration of Covenants, Conditions and Restrictions.

  1. The Association's officers, at their discretion, may contact members who have not paid their assessments after the due date (30 days after the billing invoice date), but not more than 30 days beyond that date, to collect unpaid assessments.
  2. If any assessments remain to be paid 30 days after the due date (60 days after the billing invoice date), then the president of the Association shall send a letter within the subsequent 30 days by US Mail to make known to the members involved that a ten percent (10%) penalty of the amount of the assessment now is also due with the unpaid assessments and that the amount due is also subject to interest at a rate of eight percent (8%) per annum from that same date (60 days after the billing invoice date).
  3. If by 120 days after the billing invoice date assessments are not fully paid, the president shall send a registered letter within the subsequent 30 days through the US Mail to the members who still owe their assessments. This letter shall advise the members that the Association intends to retain a lawyer to pursue collection of their assessments, penalty, and interest if they do not pay within a subsequent 30 day period of the date of the registered letter.
  4. If members persist in not paying their assessments by the due date specified in the registered letter of the previous step, the president of the Association shall retain a lawyer to pursue collection of the assessments, penalty, and interest. The lawyer shall make one final attempt to collect the assessments, penalty, and interest. If this is not successful, the lawyer shall establish a lien on behalf of the Association against the property of the members with unpaid assessments for all amounts owed the Association.
